Detention Reviews | Sokolov Immigration

Foreign nationals and permanent residents of Canada may be detained by Canada Border Services Agency (CBSA) and appear before a hearing of the Immigration Division (ID) of the Immigration and Refugee Board of Canada (IRB).

There are a few grounds for such detention:

the detained individual is unlikely to appear for an examination, hearing, or removal
the detained individual is a danger to the public
the detained individual is inadmissible
there are questions to identity of the detained individual.

If an individual is detained by the CBSA for immigration reasons, their first detention review (hearing) will occur in 48 hours. If they are not released, the second detention review will occur in 7 days. If they are not released at the second detention review, the third one will occur in 30 days.

Bonds and guarantees

An important part of the detention review process is posting a bond (a cash deposit) or a guarantee (performance bond) by a bondsperson. There are certain requirements to who can be a bondsperson.
