About residency obligation appeals

Under IRPA (Immigration and Refugee Protection Act), permanent residents are generally required to stay in Canada for 2 out of the last 5 years. There may be some exceptions to this rule.

If the visa officer finds that you are abroad and you did not meet the residency obligation, you may receive a finding that you have lost your status of the permanent resident of Canada. You may appeal this decision to the Immigration Appeal Division (IAD) of the IRB of Canada.

Who can appeal

There are no restrictions to this appeal. However if you are inside Canada and received a removal order because you did not meet the residency requirement, you will have to appeal the removal order instead of appealing the finding of not meeting the residency obligation.

You have 60 days after the refusal to start your residency obligation appeal.
