LMIA-Exempt Entrepreneur Work Permit

Usually, to come to work in Canada, one must apply for Labour Market Impact Assessment also known as LMIA. LMIA is a lengthy and laborious process which takes time, patience, and requires a lot of back-and-forth with a Service Canada officer who will be reviewing your application.

Such applications are processed under the Temporary Foreign Worker Program (TFWP). However, there is another program for work permit applications that do not require an LMIA. It is called International Mobility Program (IMP).

LMIA exemption scenario is usually accompanied by a special code grouped under Immigration and Refugee Protection Regulations (IRPR). Sections 204 to 208 of IRPR speak about such LMIA exemptions. 


R205: Significant benefit to Canada 

R205 is a broad section of IRPR that contains many LMIA-exempt work situations where an individual will bring significant benefit to Canada. Let's look at what qualifies as a significant benefit.

In determining if the significant benefit to Canada exists, it is considered if your work in Canada will:
  • create new jobs
  • promote economic development in remote or regional location
  • expand export markets for Canadian goods and services
  • develop Canadian technologies or advance a Canadian product / service
  • improve the skills of Canadians
  • benefit Canadians and permanent residents in a different way.


C11 LMIA Exemption Code: Entrepreneurs

One of the LMIA exemption codes under section R205 of the IRPR is C11: Entrepreneurs. Under this code, Canadian authorities may issue an LMIA-exempt work permit to Entrepreneurs who will bring significant benefit to Canada.

A few things that the officer may consider while making a decision whether to issue you a work permit:
  • Is the business viable? Will it benefit Canadians and permanent residents? Will it stimulate the Canadian economy?
  • Do you have the education, work experience and skills that will improve the viability of the business?
  • Your business plan
  • Do you have the finances to start the business and pay the expenditures?
  • Have you rented a premise? Have you hired anyone?
  • Is your business incorporated? Do you have a business number, ownership documents etc.?


Immigrating to Canada with a C11 Work Permit

After you have worked for one year as an Entrepreneur running your own company, you may give yourself a job offer and immigrate to Canada under the Federal Skilled Worker Program.

You will not be eligible to claim this experience to immigrate under the Canadian Experience Class because self-employment excludes you from CEC.

However, there is nothing that prevents you from getting as much as 200 CRS points for having a NOC 00 position. So, ultimately, your immigration to Canada as an Entrepreneur who brings significant benefit to Canada boils down to FSWP eligibility.
